Consider a motorcyclist who contacts BSLC after a roadside inspection in Bulgaria. The registration certificate has been taken because an officer considers the replacement exhaust unlawful. The owner has an invoice for the exhaust and a recent roadworthiness inspection, but the order does not clearly explain whether the problem is excessive noise, a removed silencer or an unauthorised modification. This illustrative situation presents several different legal questions. Proving that a motorcycle is not dangerously defective may answer one allegation while leaving another entirely unresolved.
The same urgency arises when a driver loses a licence after a test, a company discovers that its vehicle's number plates have been removed, or a car owner is affected by somebody else's driving. Appealing a compulsory traffic measure in Bulgaria requires identifying the correct order, the person entitled to challenge it and the deadline. An objection to a fine does not replace that appeal, and filing the appeal does not itself restore permission to drive. The analysis below reflects the legislation and verified decisions reviewed as at 28 October 2026.
- BSLC can assess temporary licence withdrawal following alcohol or drug testing, alleged refusal or other qualifying offences.
- The team can examine suspension of cars and motorcycles for noise, exhaust modifications, technical defects or missing insurance.
- Legal assistance can address removed number plates, terminated registration, vehicles driven by somebody other than the owner and urgent applications to suspend enforcement.
When can a compulsory traffic measure affect a driver or vehicle owner in Bulgaria?
What does the measure restrict and how does it differ from a penalty?
A compulsory administrative measure is a statutory restriction intended to protect road safety or stop an administrative offence. The relevant powers are set out in Article 171 of the Road Traffic Act (Закон за движението по пътищата, ЗДвП). A limited comparison for readers familiar with England and Wales is the power to prohibit use of an unfit vehicle under section 69 of the Road Traffic Act 1988. That comparison concerns the protective function only. The Bulgarian grounds, appeal procedure and periods below must be assessed independently.
The restriction may concern the driver's entitlement, the use or registration of a vehicle, or a regulated professional activity. It is not itself the fine or driving disqualification imposed as punishment. One inspection can nevertheless produce an administrative offence report, an order imposing a measure and a later penalty decree. A criminal investigation may also follow where the facts justify it. Each document has a separate legal function, so success in one procedure does not automatically dispose of the others.
A reasoned order is required for the measures expressly listed in Article 172(1) of ЗДвП. It must be issued by the competent head of a control service or an authorised official. The Customs measure has its own competence rule in Article 172(1а). Other actions, including particular forms of compulsory vehicle removal, require their own analysis of the applicable form and remedy. Treating every intervention as an identical police order can lead to the wrong procedure.
Drivers, owners, companies, vehicle lessors and transport operators may all be affected, but their positions differ. A motorcycle is subject to the same basic requirements concerning entitlement, registration and lawful use, with technical requirements appropriate to its category. Foreign nationality does not exclude protection or create immunity. Permanent address, normal residence and the country issuing a licence are separate criteria and should never be treated as interchangeable.
When can a driving licence be temporarily withdrawn?
Temporary withdrawal under Article 171, point 1 of ЗДвП concerns the driver, whether driving a car or riding a motorcycle. An apparent failure to satisfy medical or psychological requirements falls under letter “а” and continues until its ground ceases. The evidence should identify the actual condition. A general impression that somebody seems unfit is not a substitute for examining the relevant signs and documents.
Alcohol above 0.5 per mille, drug use or use of analogous substances, and the specified refusals of testing or examination fall under letter “б”. The measure continues until liability is determined, subject to a maximum of 18 months. Where a blood sample or evidential analyser examination under Article 174(4) provides a result, the statutory rule makes that result determinative. Reviewing the test, referral, samples and subsequent laboratory evidence can therefore be decisive. A refusal allegation requires examination of precisely what was requested and what the person actually refused.
Several further grounds have different purposes and endpoints. Under letter “в”, a non-minor breach caused by lack of knowledge leads to withdrawal until a verification examination is passed. The breach alone does not establish that ignorance caused it. Under letter “г”, public passenger or goods transport in a vehicle omitted from the relevant licence or registration list leads to withdrawal until rectification, for no more than 12 months. Actual public transport must be established. The mere presence of passengers does not answer that question.
Driving without compulsory motor third-party liability insurance falls under letter “е”. Withdrawal continues until information about valid insurance is supplied, for no more than six months. Insurance coverage and its relevant dates matter more than possession of a paper copy. Under letter “ж”, entering beyond a prohibitory sign during a temporary restriction outside a built-up area produces a one-month measure. Its validity depends on the actual restriction, signage and vehicle category.
The newer letter “и” concerns a driver holding a licence issued by an EU, EEA or Swiss authority under Article 161, point 5, who has established normal residence in Bulgaria and commits an offence carrying a deduction of control points. Withdrawal lasts until exchange for a Bulgarian licence. This is not a general power to take every tourist's foreign licence. The remaining new ground, letter “з”, requires separate attention because it covers several groups of offences carrying driving disqualification.
How long can the newer licence measure last?
For cases outside the preceding grounds, Article 171, point 1, letter “з” of ЗДвП permits temporary withdrawal where the offence carries driving disqualification. The measure ends when liability is determined, subject to the relevant statutory maximum. That ceiling is not the same as the eventual penalty and must be tied to the correct offence provision.
- One month applies to the offences identified in Article 182(1), point 5 and Article 182(2), point 6, together with Article 183(6) and (7).
- Three months applies to Article 175(1) and (5), Article 177(5), Article 178ж(1), Article 182(1), point 6, Article 182(3), point 6, Article 182(4) and Article 183(8).
- Three months also applies to the specified average-speed cases under Article 182(3а), read with Article 182(1), point 6 and Article 182(3), point 6.
- Six months applies to Article 175(2) and (3), Article 176(1), Article 178ж(2) and Article 182(5).
- Twelve months applies to Article 175(4), Article 175а(1) and Article 176(2).
- Eighteen months applies to Article 175а(2).
These cross-references cover speeding, registration and number-plate offences, unauthorised emergency signals, failures to comply with specified police directions or accident-related duties, motorway restrictions, dangerous-goods requirements and unauthorised racing. Repetition or systematic offending can change the applicable category. A useful defence therefore examines the constituent facts and earlier decisions rather than accepting the longest period mentioned in a form.
Particular care is needed with the reference to Article 177(5). It does not remove the overarching requirement in letter “з” for an offence carrying driving disqualification. The authority must establish the complete applicable legal basis. A citation appearing in a statutory list does not resolve every question about how that list interacts with the opening condition.
When can the vehicle itself be taken off the road?
Suspension from use under Article 171, point 2 of ЗДвП restricts a specific vehicle. Under letter “а”, the grounds are a dangerous defect, emissions above prescribed limits, noise above prescribed limits, an unauthorised construction modification or removed silencers. The measure continues until the defect is remedied. Their distinct evidential requirements are examined in the next section.
The other operative grounds should also be distinguished. Under letter “б”, a vehicle carrying dangerous goods is suspended if it fails the requirements for the class and type of goods actually carried, until compliance is restored. Under letter “в”, the owner's lack of compulsory motor insurance results in suspension until insurance is obtained. This is separate from withdrawing the driver's licence for driving without insurance. Under letter “д”, a vehicle displaying taxi markings may be suspended where it is not included in the appropriate authorised list or fails the regulatory requirements. The provision does not set a fixed number of months for that situation.
Serious speeding under letter “л” produces a one-month suspension when the vehicle exceeds the limit by more than 40 km/h in a built-up area or more than 50 km/h outside one. Since the 2025 amendment, the wording concerns the owner of the vehicle used and does not require the owner personally to have driven. A company or lessor should therefore investigate both the offence and its own legal position.
Unauthorised racing and use of roads for purposes other than transporting people and goods fall under letter “м”. The three-month measure depends on the owner's conduct specified there, including permitting, organising or providing the vehicle for the activity. Drifting may qualify, but a skid is not automatically proof of an unauthorised race. Under letter “о”, excessive statutory dimensions, mass or axle loading without the required permit produce suspension until rectification or presentation of the permit. Under letter “п”, goods transport exceeding the technical mass or axle-load limits recorded in the registration certificate produces a one-month suspension. The two overloading grounds use different reference limits.
When are registration and number plates affected?
Registration termination under Article 171, point 2а of ЗДвП lasts between six months and one year. The chosen period must be justified. Letter “а” covers driving without the requisite entitlement, without a licence valid for the category, while disqualified or while the licence has been withdrawn on the statutory grounds. It also reaches an owner whose vehicle is driven by another person in that position. Ownership documents, the actual driver and the precise licence status are therefore essential evidence.
Letter “б” concerns an owner who personally drives with alcohol above 0.5 per mille, after drug use or in the specified refusal circumstances. The 2025 amendment developed the refusal provisions, including non-compliance with directions for evidential analysis or medical examination and biological samples. The rule extending letter “а” to another driver must not simply be imported into letter “б”. The measure ends if the vehicle is confiscated or otherwise forfeited to the State. Plate removal alone does not transfer ownership, and administrative registration measures must remain distinct from criminal forfeiture.
A different mechanism applies where a driver has no permanent address in Bulgaria. Under the new Article 171, point 2б, an offence committed with the vehicle can lead to removal of its plates and registration certificate for up to three months. The criterion is the driver's address, not citizenship or foreign registration. Under Article 172(1), immediate payment of the particular fine prevents the order and seizure; payment during the measure's term terminates it. Under Article 172(4а), service on the driver is also deemed service on the owner. Rental and company vehicles need prompt internal reporting because an absent owner can otherwise lose valuable appeal time.
What other measures and earlier rules must be considered?
The remaining grounds in Article 171 of ЗДвП extend beyond the most familiar roadside cases. Point 3 allows detention to establish ownership where a registered vehicle, or one requiring registration, has an erased, removed or altered manufacturer's frame or chassis identification number. Point 4 permits seizure of an unsurrendered licence after driving entitlement has been lost through exhaustion of control points under Article 157(4). Point 4а concerns defects in the issue or exchange of a licence, including false, forged or altered documents or failure to satisfy the conditions for issue. Each requires proof of its particular facts.
Compulsory removal under point 5 covers four situations. Letter “а” concerns a lawfully parked vehicle that circumstances require to be moved. Letter “б” concerns unlawful parking where a removal warning sign is present, or where the vehicle creates danger or prevents passage. Letter “в” covers missing plates in their designated positions or the statutory situation after 30 days following withdrawal or surrender of the registration certificate. Letter “г” concerns unpaid parking and the specified cases after the permitted time expires. For lawful parking the requesting person or organisation bears the removal cost; under letter “б”, the owner does. The latter provision also regulates retention for payment and when storage charges begin.
Professional operators face temporary suspension under point 6 if they hold permits under Article 148, Article 152(1), point 3 or Article 157(3), until identified breaches are remedied. Point 7 similarly concerns psychological assessment providers registered under Article 153в. Under point 8, a vehicle owing the applicable road-use charge may be prevented from continuing until payment, for no more than one month. Its category and charging obligation must be identified, and the special payments in Article 172(9) can prevent or terminate the measure.
Older texts require caution. In Judgment No. 3 of 23 March 2021 in constitutional case No. 11/2020, the Constitutional Court declared the former Article 171, point 1, letter “д” and point 2, letter “к” unconstitutional. They permitted licence withdrawal and vehicle suspension for unpaid fines. They are not operative general grounds, but that judgment does not automatically invalidate the differently framed point 2б introduced in 2025. Other repealed letters in point 2 must likewise not be presented as current powers. The version applicable to the order, later relevant events and transitional provisions all matter.
When do technical defects, tuning or exhaust noise justify taking a vehicle off the road?
What changed on 7 September 2025?
The central distinction is in the wording of Article 171, point 2, letter “а” of ЗДвП. Before the amendment, technical unroadworthiness was the general ground, including excessive emissions or noise and unauthorised construction changes. From 7 September 2025, the general defect ground requires a dangerous defect. Removed silencers were brought into the same provision, and their former separate ground in letter “е” was repealed. The change can be checked in the amendments published in State Gazette issue 64 of 2025.
The provision nevertheless contains five alternative grounds. A dangerous defect is one. Excessive emissions, excessive noise, an unauthorised construction change and removed silencers are the other four. It would be inaccurate to say that every unauthorised modification now requires an additional finding of danger before any measure is possible. Equally, describing a vehicle as having a major defect does not automatically establish a dangerous defect. The order must identify facts supporting the ground actually used.
This distinction changes the questions a lawyer asks. If an officer alleges only technical unroadworthiness, the classification of the defect is central. If the allegation concerns an engine conversion without approval, the nature of the conversion and the approval requirement become central. Where noise is relied upon, the applicable limit and supporting assessment must be examined. A defence copied from an older case may miss the decisive issue.
What must be established for a dangerous defect?
A dangerous defect is a defined legal category under paragraph 6, point 73 of the Additional Provisions of ЗДвП. It concerns a defect found during inspection that presents a direct and immediate risk to road safety or affects the environment. The definition also encompasses defects concerning load security. Calling a condition dangerous is therefore a legal conclusion that must be supported by an adequately described physical condition and the applicable technical assessment.
For a car or motorcycle, the evidence may concern braking, steering, tyres, structural components or attachment of parts. A loose exhaust component with a serious risk of detachment raises a different question from an exhaust whose sound has changed. The distinction between major and dangerous defects should be checked against the relevant inspection criteria rather than assumed from the fact that a component is aftermarket.
The practical task is to preserve an accurate record before repairs obscure the original condition. Photographs, inspection findings and a specialist's reasoned assessment can clarify what was actually observed. Rectification may be necessary to obtain lawful return to use, but rectification and proof that the original order was lawful are separate issues. A person should not continue driving an unsafe vehicle merely to preserve evidence.
When is a modification legally significant?
The approval framework is developed in the Ordinance No. Н-3 of 18 February 2013 on Alteration of the Construction of Registered Road Vehicles and Individual Approval of Road Vehicles Registered Outside the Member States of the European Union or Another State Party to the Agreement on the European Economic Area (Наредба № Н-3 от 18.02.2013 г. за изменение в конструкцията на регистрираните пътни превозни средства и индивидуално одобряване на пътни превозни средства, регистрирани извън държавите - членки на Европейския съюз, или друга държава - страна по Споразумението за Европейското икономическо пространство, Н-3). The closest practical comparison in England and Wales is the separate vehicle-approval regime, including approval for radically altered motorcycles. It is an analogy about approval, not a substitute for the Bulgarian requirements.
Changes to technical data or manufacturer-specified characteristics, and the addition of systems, components or equipment, must be examined under Article 3(1), points 1 and 2 of Н-3. Its paragraph 2 also provides exceptions. For example, under point 2 of that paragraph, replacing an engine with one of the same type, make, model and code, with unchanged mounting, does not constitute the specified construction alteration. Requirements concerning approved components are addressed in Article 4. A different appearance or a non-original part is not, by itself, a complete legal analysis.
For an engine, suspension, air filter or exhaust dispute, the evidence should establish the factory specification or previously approved configuration, the actual change, the relevant approval requirement and any approval already obtained. An invoice proves acquisition, but may not prove approval for that vehicle or installation. Likewise, a component's approval marking and a passed annual inspection do not necessarily resolve whether a separate construction change was properly approved.
Is a sound-level meter always required?
Inspection methodology appears in the Ordinance No. Н-32 of 16 December 2011 on Periodic Inspections to Verify the Roadworthiness of Road Vehicles (Наредба № Н-32 от 16.12.2011 г. за периодичните прегледи за проверка на техническата изправност на пътните превозни средства, Н-32). Its nearest practical counterpart for readers in England and Wales is the MOT inspection framework. The motorcycle inspection guidance also distinguishes noise assessment from defects creating a risk of detachment, although Bulgarian criteria govern a Bulgarian order.
The methodology in Annex 5, point 8.1.1 of Н-32 provides for subjective assessment of the noise-reduction system and permits measurement where the specialist considers the noise may be around the permissible boundary. Consequently, the absence of a sound-level meter does not automatically invalidate every noise-related measure. An obviously removed silencer can raise a distinct ground capable of being established by inspection.
Conversely, an unsupported description that a motorcycle is very loud does not relieve the authority of proving its chosen ground. The applicable vehicle category, approval characteristics, installation and inspection conditions matter. Where a measurement exists, its method, equipment, engine operating conditions and comparison value should be checked. There is no single universal decibel limit that resolves every dispute involving every car and motorcycle.
What evidence makes a technical challenge useful?
A useful technical challenge links each piece of evidence to the allegation in the order. A photograph may show that a silencer was present, but not establish compliance with an applicable noise limit. A test may establish a noise level, but not decide whether an engine conversion required approval. A technical expert may need to answer several separate questions rather than give a broad opinion that the vehicle is generally roadworthy.
- The order and inspection report should identify the component, alleged defect or alteration and applicable legal ground.
- Registration records and manufacturer information can establish the vehicle's original or approved specification.
- Approval certificates, component documentation and installation records can explain whether a modification was authorised.
- Photographs, recordings and reliable measurements can support or contradict the factual account.
The timing of evidence also matters. A repair invoice issued after the inspection may help demonstrate that a condition has been remedied. It does not necessarily show what was present when the order was issued. A current inspection result should therefore be presented with an explanation of any intervening repairs. This is particularly important where returning the vehicle to lawful use and challenging the original order proceed at the same time.
What do the verified court decisions show?
In Judgment No. 9831 of 27 July 2026 in administrative case No. 1287/2026, Varna Administrative Court, the court annulled a measure founded on a general statement that part of the noise-reduction system was missing. It distinguished the alternative grounds in the amended provision and required concrete facts supporting the measure. The decision demonstrates why an unspecified missing part should not automatically be equated with every statutory form of unlawful exhaust condition.
A different outcome followed in Judgment No. 937 of 8 May 2026 in administrative case No. 79/2026, Kardzhali Administrative Court. The court upheld suspension involving an engine with a different code and an unauthorised construction alteration. The decision applied the amended wording and illustrates why absence of a separate dangerous-defect finding is not a universal answer to a modification case.
The earlier wording was considered in Judgment No. 10934 of 5 July 2024 in administrative case No. 11258/2023, Administrative Court Sofia City. The court annulled a measure concerning a replacement rear exhaust because the evidence did not adequately establish the alleged defect and its effect on noise. These decisions concern different facts and statutory versions. They support careful identification of the actual defect in an order, rather than a promise that every modified exhaust or unmeasured noise allegation will produce the same result.
How can you appeal the measure and assess the costs and prospects of success?
Who may appeal and when does the deadline begin?
The general procedure is governed by the Administrative Procedure Code (Административнопроцесуален кодекс, АПК), applied through Article 172(5) of ЗДвП. Its review of public-authority decisions has a functional parallel with judicial review under Part 54 of the Civil Procedure Rules in England and Wales. The English rules have their own permission and time-limit requirements, which must not be imported into a Bulgarian appeal.
Standing depends on a direct effect on the person's rights, freedoms or legitimate interests, or obligations created for them, under Article 147(1) of АПК. The driver is ordinarily the relevant appellant for licence withdrawal, and the owner for suspension or registration termination. A lessee or user must establish their own interest. Being present at the inspection does not automatically create standing to challenge every related order.
The usual deadline is 14 days from proper notification under Article 149(1). The appeal is addressed to the competent administrative court and filed through the issuing authority under Article 152(1). Jurisdiction is ordinarily determined by the named addressee's permanent address or registered office under Article 133. Where the relevant address or office is abroad, the statutory rule points to Administrative Court Sofia City. Foreign appellants remain entitled to legal protection, with the proceedings conducted in Bulgarian and translation or interpretation addressed where necessary.
Service documents should be preserved. An envelope, receipt or electronic notification can determine whether the appeal is timely. Missing appeal instructions can engage the two-month rule in Article 140(1); an incorrect statement that the act is not appealable can engage the six-month rule in paragraph 2. These are fact-dependent safeguards, not reasons to delay. Under Article 172(4а) of ЗДвП, service on the driver in a point 2б case also counts as service on the owner. Sending an enquiry to a lawyer or requesting a document from the police does not itself preserve the appeal period.
How does the administrative or court procedure develop?
Where an administrative appeal is available, the order can be challenged before the immediately superior authority. That route ordinarily need not be exhausted before going to court, because Article 148 of АПК permits a direct judicial challenge unless a specific rule provides otherwise. If the administrative route is used, the subsequent court deadline follows Article 149(3), running from notification of the decision or expiry of the period for deciding. An informal complaint about an officer is not necessarily an administrative appeal against the order.
The judicial appeal must identify the appellant and challenged act, state the request and grounds, be signed and include the required attachments under Articles 150 and 151. The court examines admissibility and formal compliance, obtains the administrative file and arranges evidence. Witness testimony or an expert assessment may be needed. The judgment deadline under Article 172(1) runs from the hearing at which examination of the case concludes. It is not a promise that the entire case will finish within a month of filing.
An administrative offence report should not be confused with the order. In Order No. 8547 of 6 August 2026 in administrative case No. 7464/2026, Seventh Division of the Supreme Administrative Court, the court explained the distinction between physical seizure when the offence report is drawn up and the measure imposed by an order. Challenging a report or fine is not a substitute for identifying and challenging the operative measure. A generic appeal template cannot safely resolve that distinction without the actual documents.
The licence is seized when the administrative offence report is drawn up in the cases under Article 171, point 1, letters “б”, “е”, “ж”, “з” and “и”, as required by Article 172(3) of ЗДвП. The registration certificate is seized at that stage in the cases under Article 171, point 2, letters “а”, “б”, “в”, “л”, “м”, “о” and “п”, and point 2а; the plates are also seized in point 2а cases under Article 172(4). Physical seizure therefore needs to be distinguished from the reasoned order and its judicial challenge.
What defects can justify annulment?
The grounds of review are set out in Article 146 of АПК. They include lack of competence, failure to observe the required form, substantial procedural breaches, conflict with substantive law and inconsistency with the statutory purpose. Proportionality under Article 6 also matters. Review should therefore address who signed the order and under what authorisation, what facts and legal grounds it gives, what evidence supports them and how any selected duration was justified.
Under Article 170(1), the authority must establish the factual grounds and compliance with the legal requirements. The appellant should nevertheless submit their own relevant evidence promptly. The court's duty under Article 168 to examine legality on all Article 146 grounds does not make an incomplete factual defence a sound strategy. A minor typing error is different from an inability to identify the vehicle, the person, the alleged conduct or the actual statutory ground.
The most useful initial documents are the order, service evidence, the offence report and the relevant ownership, licence, registration and insurance records. Technical cases require the additional material described above. Testing cases may turn on laboratory results and procedural documents. Where the case concerns another driver's conduct, records establishing who used the vehicle and that person's actual entitlement may be critical. The evidence should be organised around disputed legal conditions rather than submitted as an unexplained bundle.
Can enforcement be suspended while the appeal is pending?
Filing does not suspend the measure under Article 172(6) of ЗДвП. An order may therefore be enforceable while it remains open to challenge. A separate application for a stay can be made under Article 166(4), read with paragraph 2, of АПК. It requires a concrete assessment of significant or difficult-to-remedy harm, the applicable requirement for new circumstances and the competing public interest. Employment responsibilities, income, health needs and transport alternatives should be evidenced, not merely asserted.
The general availability of judicial control over enforcement arising directly from legislation was confirmed in Interpretative Judgment No. 5 of 8 September 2009 in interpretative case No. 1/2009, the Joint Assembly of the First and Second Colleges of the Supreme Administrative Court. The judgment treats Article 166(2) as applicable where legislation permits immediate enforcement without expressly excluding judicial control. It does not mean that every application must succeed.
The need for evidence is illustrated by Order No. 8693 of 21 August 2026 in administrative case No. 7954/2026, the Supreme Administrative Court. A stay was refused in a motorcycle number-plate case where alleged employment consequences and the necessary new circumstances were not adequately established. By contrast, in Order No. 8560 of 6 August 2026 in administrative case No. 7576/2026, the same court granted a stay following an individual proportionality assessment involving a non-owner driver and recently terminated registration after the owner's death, without evidence that the driver knew. That was interim protection, not final annulment. A first-instance stay ruling can be challenged within seven days under Article 166(3) of АПК.
What does an appeal cost and can success be guaranteed?
The court fee is only one part of the cost. The official first-instance administrative appeal fees applicable from 1 January 2026 are €5.11 for individuals who are not traders and non-profit legal entities, and €25.56 for other legal entities and individuals acting as traders. A permitted interlocutory appeal carries a separate fee under Article 235а of АПК, currently €15.34 for individuals and €76.69 for organisations, as shown in the court's published fee information.
Lawyer's fees are agreed separately, and expert evidence, translation or interpretation can add costs. The scope should identify whether it covers the principal appeal, an urgent stay application, hearings and any permissible procedural appeal. Under Article 143 of АПК, a successful appellant may recover proven and properly requested costs, including representation by one lawyer, but the amount awarded need not equal the whole amount paid. An unsuccessful appellant can also face the other side's recoverable costs. A realistic budget should address both possibilities.
No responsible assessment can promise the decision of an independent court. The Bar Act (Закон за адвокатурата, ЗА) expressly prohibits advertising that creates unjustified expectations of an outcome outside the lawyer's control, under Article 42(3), point 4. A comparable professional principle in England and Wales is the requirement for accurate, non-misleading publicity in paragraph 8.8 of the solicitors' code of conduct. A useful assessment instead explains the strongest grounds, evidential weaknesses, likely procedural steps and costs. Another person's successful case may inform that analysis, but cannot replace it.
What happens after the judgment or when the measure's ground disappears?
For orders within Article 172(1) of ЗДвП, the administrative court's judgment is final under paragraph 5. There is no ordinary cassation appeal on the merits. This does not exclude procedural appeals where the law permits them, and should not be extended automatically to every other traffic-related action. Nullity remains distinct from ordinary unlawfulness, while extraordinary reopening of a final judgment under Articles 237 to 244 of АПК is available only on the prescribed grounds. Reopening administrative proceedings under Articles 99 to 106 is a separate remedy. Neither is an optional second opportunity to repeat a rejected case.
Annulment, a judicial stay, expiry of the measure and disappearance of its statutory ground are also distinct. A repaired vehicle does not automatically recover its registration status, and a pending case does not authorise driving. Return of a registration certificate and lawful return to use require the applicable procedure, including the rules referred to in Article 172(4) of ЗДвП. Insurance cases require evidence of valid coverage. Alcohol and drug cases require monitoring of the determinative results and liability decision, with examination costs addressed separately under Article 172а where applicable.
Payment ends the point 2б measure under Article 172(1), while paragraphs 8 to 10 of the same article set special service, payment and document-return rules for road-charge measures. After the latter measure expires, Customs retains the registration document until the owner or authorised representative requests it. The limited transport permission in Article 172(7) applies only to the listed cases under point 2а, point 2б and point 1, letters “б” and “е”. It allows transport by a duly licensed driver to storage or the nearest settlement within 12 hours of discovering the offence. It is not a general permission to continue using every suspended or dangerous vehicle.
The practical objective is to establish both the legal outcome and the steps needed to restore lawful driving or vehicle use. The controlling decision, outstanding grounds for restriction, physical return of documents and relevant registration records must be checked together. This prevents a favourable procedural development from being mistaken for permission to drive before the necessary legal conditions have been satisfied.
